There is a new dance craze that is sweeping the country right now, and it isn’t The Dougie. It’s the Limbo Court Rock !

I agree that there is “judicial uncertainty” in the country right now which is making the job of executives like Noynoy Aquino very difficult.

In essence, the Supreme Court should be the built-in safeguard and the designated arbiter. When disagreements or questions arise, it should be premised on a fundamental assumption that it will be objective and nonpartisan.

But the whole country was surprised when the Supreme Court, which normally takes 10 days to attend to motions, decides to issue a TRO for Arroyo in just three days. One cannot avoid wondering what Arroyo did to merit such speedy relief from the Justices.

It is questionable how the Supreme Court could grant Arroyo’s petition for a TRO when a review of the documents that her camp had submitted to support her request to travel showed that she could not decide which places to go to, how many persons to take with her, or whether to see doctors for medical treatment or attend a forum. One can’t avoid wondering if Arroyo’s real intention was to escape the arm of the law.

I believe that the Aquino administration is not out to dictate upon the court, much less spark a constitutional crisis.They are just questioning the court not out of a desire to undermine the court justices’ positions, not out of disrespect and malice, but to fulfill their mandate and to heed their bosses, the Filipino people.

When the court itself, in granting exceptionally speedy relief to Mrs. Arroyo, set conditions for her to be able to leave—only to say, afterwards, those conditions didn’t have to be met before Mrs. Arroyo left—who can avoid asking, why then did the court impose conditions it had no intention of seeing fulfilled?

In these cases, the Supreme Court did not follow its own precedents and rules. It is then fair of the Aquino administration to wonder whether objectivity has given way to partisanship. It is fair of them to express concern at the direction the Supreme Court is taking.

Aquino assailed the Supreme Court for its several reversal of decisions that made the job of the executive branch “untenable.” According to Aquino, the Supreme Court would often reverse itself repeatedly leaving everyone in limbo. He added that the Supreme Court seems to be dealing with neither abstract rules nor theories.

The lives and well-being of our fellow citizens are at stake. When the status is in limbo, how could anyone respond to the people involved as they clamor for the continued existence of fairness and justice to their specific cases.

You can fully appreciate how untenable the Aquino government’s situation is, when we could clearly see that we have a very much confused—and confusing—Supreme Court.
